By submitting this form and booking a photography session with Lilyana Osborne Photo, the Client acknowledges and agrees that this agreement must be reviewed, accepted, and confirmed by the Photographer before any services are rendered. Once the Client submits this form, the Photographer will contact the Client regarding session logistics, scheduling, location preferences, creative direction, and other relevant details.

To reserve the Client’s session date and time, a non-refundable retainer fee of $25.00 is required upon confirmation by the Photographer. The Client acknowledges that this retainer is earned upon payment in exchange for reserving the Photographer’s time. The retainer is non-refundable under all circumstances, including cancellations, no-shows, reschedules, or rain checks. Any rescheduling or rain checks due to weather, illness, or other unforeseen circumstances (whether affecting the Client or the Photographer) may be offered solely at the Photographer’s discretion and subject to availability; however, the retainer shall not be transferred or credited unless expressly agreed to in writing by the Photographer, and remains non-refundable as it reserves the session date and time.

The remaining balance for photography services is due in full on the day of the scheduled session. The Photographer reserves the right to withhold all photographs, previews, and deliverables until full payment has been received.

Edited photographs will be delivered within approximately seven (7) business days following the session date, unless otherwise communicated by the Photographer. The Photographer will store final edited images for up to 30 days after delivery. The Client is solely responsible for downloading and backing up all delivered files within this period, as the Photographer is not obligated to maintain long-term storage and files may be permanently deleted after 30 days.

In the event of technical difficulties, including but not limited to equipment malfunction, file corruption, or other unforeseen issues affecting image capture or delivery, the Photographer will offer one complimentary reshoot session at no additional cost, subject to availability. The Client acknowledges that this reshoot is the primary remedy, and no refunds shall be issued for technical failures.

To the fullest extent permitted by law, the Photographer shall not be liable for any indirect, incidental, consequential, or emotional damages arising from the photography session, image delivery, or use of final photographs. The Photographer’s total liability for any claim arising out of or related to the services provided shall not exceed the total amount paid by the Client for the session.

The Client acknowledges that the Photographer retains full creative and artistic control over the session and final images. All photographs remain the intellectual property of the Photographer, who may use images for portfolio, website, social media, and promotional purposes unless the Client submits a written request to opt out prior to the session date.
